Your Guide To Compensation Claims in the UK |

The Workman’s Compensation Act was introduced way back in 1897 in order to compensate workers for a loss of earnings, as a result of injuries sustained whilst at work. This was extended by another Act in 1906 and in July 1948, workman's compensation was replaced by the industrial injuries scheme. The basic premise of workers compensation is that it ensures that employers must accept liability, albeit without fault, for injuries sustained by workers in the course of their daily duties. Under the workman’s compensation act and the subsequent industrial injuries scheme, employers are obliged to offer: * Protection of employment (In other words, employers cannot legally fire employees due to injury) * Continuation of pay throughout injury * Payment of medical expenses In many situations, a worker’s compensation claim is paid out without query, and provides an invaluable lifeline for the injured party to support themselves and their family. Most employers have insurance which pays out in the event of worker injury and they are not, therefore responsible for the financial burden of the payouts. In some cases, however, a worker may have difficulty claiming compensation, due to either a dispute with the employer, or the insurance company. It is worth noting that in many cases, the employer may want to protect their own interests by avoiding the payment of compensation as this will cause their insurance premiums to rise. The insurance companies themselves are notoriously clever at finding loopholes to avoid paying out. In this instance, the worker would be well advised to contact a solicitor.
